UNDERSTANDING TYPES OF CASES
Search your name for a record of all charges and convictions in the state of Iowa.
It will not have any reference to expunged and deferred records.
The public and free account can give you many details about charges, dates, disposition, general
nancial information, and a list of lings.
The paid account includes more information, such as: more details about the nancial status of the
case, parties, exhibits, judgments/liens, property, and trafc details.
Here is a sentencing chart that can let you know what sentence might be imposed.

WHAT IS A RAP SHEET?
Does Iowa have one? Yes, you can request via mail, fax, in person, or online. You will need to sign a
release authorization on the Criminal History Record Check Request form.

Federal FBI RAP Sheet: Record of all arrests, charges, dismissals, convictions, ngerprinting, and
expunged records
Who has access to this? Most people cannot access it, as it is a record created and maintained by
law enforcement.

How can I get access to this? You can go directly to the FBI to request it, or you can go through
what is called a “channeler,” a private company authorized by the FBI to process requests.

It cannot be seen by anyone, except limited judicial branch staff and by court order.

It is manual.
HOW CAN I PETITION?
The defendant submits and application in the county where they were convicted. The court is
required to expunge if all the requirements are met.
WHAT ARE SOME STRAGEGIES FOR DECIDING WHAT TO EXPUNGE?
Was one of your misdemeanor convictions originally charged as a felony? What type of work do
you want to do, and is a particular conviction a barrier?
INELIGIBLE MISDEMEANORS
WHAT ARE THE REQUIREMENTS?
Only one in your lifetime: Although multiple misdemeanor convictions can be expunged if
they come from the same transaction or occurrence.
It is 8 years after the conviction/nal adjudication.
You cannot have 2 deferred judgments.
All court debt have been paid.
There are no pending criminal charge.

There is no limit on how many of these expungments you can receive.
IS IT MANUAL OR AUTOMATIC?
It is manual.
HOW CAN I PETITION?
Via an application by the defendant (or a prosecutor) or through the court’s own motion. There
needs to be time for the parties to object if the elements are not met.
WHAT IS THE EFFECT OF THE EXPUNGEMENT?
It can be seen by court, plus anyone on the “deferred judgment docket.”
The deferred judgment docket is “available only to justices of the supreme court, judges
of the court of appeals, district judges, district associate judges, judicial magistrates,
clerks of the district court, judicial district departments of correctional services, county
attorneys, the department of public safety, and the department of corrections requesting
information pursuant to this section, or the designee of a justice, judge, magistrate, clerk,
judicial district department of correctional services, or county attorneys, or departments.
WHAT ARE THE REQUIREMENTS?
180 days after case was dismissed (there may be an exception if you are a victim of
identity theft or mistaken identity).
Have to pay court debt in case.
Acquittal cannot be because of insanity.
Dismissal cannot be because of incompetence.
Dismissal / Acquittal must be of all charges.
Only “public offenses” (Iowa Code § 692.1).
Covers “not led” and “withdrawn” matters.

WHAT IF IT WAS AN ADULT CASE TRANSFERRED TO JUVENILE COURT? (Iowa Code § 232.8(b))
It is automatic.
WHAT IS THE EFFECT?
It cannot be seen by anyone, save a limited amount of judicial branch staff: “sealed records shall
no longer be deemed to exist as a matter of law.”
IS IT MANUAL OR AUTOMATIC?
Before 2015, it was manual. After 2015, there are automatic hearings.
HOW CAN I PETITION?
Now that it is automatic, it is done by the court. The court schedules a sealing of records hearing 2
years after the date of the last action on the case or on the date the juvenile turns 18 (whichever is
later).
A person who was “subject of a complaint or petition alleging delinquency that did not result in an
adjudication” can le an application for a hearing.

C. Sealing Juvenile Records (Iowa Code § 232.150)
WHAT ARE THE REQUIREMENTS?
Not youthful offender status (tried as adult, not as juvenile).
Need to be 18 or has to be 2 years from disposition (whichever is later).
No subsequent or pending conviction (FECR, AGCR, SRCR).
If the conviction was a FECR or an AGCR, it needs to be in the best interest of the
juvenile and public.
Did not get a OWI (Iowa Code § 321J.2).
If restitution hasn’t been fully paid, the case records can be sealed, but “the name of the
court, the title of the action, and the court’s le number shall remain unsealed” and there
will be a lien until restitution is fully paid.

HOW THEY WORK?
Upon successfully completing your sentence, the “conviction” is considered wiped from your
record. It is not considered to be a conviction. And there is a civil penalty.
IS IT AUTOMATIC OR MANUAL?
It is mostly automatic.
WHAT IS THE EFFECT OF DEFERRED JUDGMENT?
It can be seen by anyone on the deferred judgment docket (Iowa Code § 907.4).
Note that condentiality can be waived on DPS / DCI form (See Iowa Code 692.2).

This does not require a guilty plea. Upon completion of a sentence the case can be dismissed and
subject to expungement options.

This happens before entering into a plea.

D. Deferred Judgments (Iowa Code §§ 907.3, 907.9)
WHAT ARE THE REQUIREMENTS?
You have to successfully complete probation.
You have to notify court of completion if you have unsupervised probation.
You have to pay debt.
If there are convictions on same case, it does not apply to those.
You cannot have been convicted of a felony anywhere in the U.S.
You cannot have more than 2 in your lifetime.

§ 232.69 in which the victim is a person who is under the age of eighteen
§ 124.401(1)(a), (b) Manufacture, deliver, or possess with intent to deliver or manufacture methamphetamine

If the alcohol concentration exceeds .15
If the defendant had another OWI
If the defendant has previously received a deferred judgment or sentence for an OWI
If the defendant refused to consent to testing requested in accordance with § 321J.6.

You need to petition the court two years after the conviction.

There is the possibility of an expungement if the juvenile is sex trafcking survivor.
WHAT ARE THE REQUIREMENTS?
Under 18 when offense (prostitution) was committed.
Not convicted of any other offense (other than trafc / alcohol related) two years following
disposition.

HOW DO I GET A COMMUTATION OF MY SENTENCE?
Fill out an application and petition the governor.

WHAT IS THE EFFECT OF A COMMUTATION?
It reduces the length of a sentence. It can reduce a life sentence to a term of years with the
possibility of parole, and it can reduce a mandatory minimum to a lesser amount of years.

WHAT DOES THE PROCESS LOOK LIKE?
You can only apply every 10 years.
You apply to Iowa Board of Parole (Iowa Board of Parole, 510 East 12th Street, Suite 3, Des
Moines, Iowa 50319).
There will be investigation and review.
It is submitted to Governor for nal decision.

Fill out an application and petition the governor.

WHAT IS THE EFFECT?
It restores all rights lost with a conviction (i.e., right to vote, right to possess a rearm, right to hold
public ofce).

It does not expunge the record, but you cannot receive any more punishment from that conviction.
WHAT ARE THE REQUIREMENTS?
Any conviction in Iowa (except treason and cases of impeachment).
You usually need to wait 10 years after completing sentence (this is to show that you are
responsible, productive, and leading a law-abiding life).
You cannot pardon deferred judgments, because it is not a conviction.
WHAT IS THE PROCESS?
Submit application to Iowa Board of Parole.
It will be reviewed by administrative staff.
It may be forwarded on to the Iowa Division of Criminal Investigations.
The Iowa Board of Parole will review.
The application is then sent to the Governor (submitting a recommendation).
The Governor makes the nal review.
It may take around 2 years.

Most non-serious conviction in Iowa are allowed.
Usually need to wait 5 years after completing sentence (this is to show that you are
responsible, productive, and leading a law-abiding life).

Complete sentence: You must be successfully discharged from your sentence.
Include/excluded felonies: Homicide and Related Crimes (Iowa Code § 907.4 707).
Fines/fees requirement: You do not need to be paid in full or even on a payment
plan to vote. You still have the obligation, but your right to vote is not tied to the
payment.

One of the most common ways to register to vote is at the DOT. When you renew or obtain a
driver’s license you can also register to vote. You can also register to vote online.

AT THE POLLS
In Iowa, you can register to vote at the polls! If you are otherwise eligible to vote, just show up at
your precinct and register to vote the day of the election.
The most common way to vote is at the polls themselves. You will have to bring an ID, so they can
verify who you are.
Make sure you’re going to your precinct or polling place.

You must be a U.S. Citizen.
You must be an Iowan resident.
You need to be 18 by the time of the election.
WHAT ARE THE VOTER ID REQUIREMENTS?
You need to have a voter ID in order to vote.
A Driver’s License is the most common form of a voter ID, but you can also get a specic
voter ID card.
If you need an Iowa Voter ID Card, you must contact your county auditor’s ofce.

AT WILL POLICIES
Iowa is an at will state, that means you can be red for any reason and your employer does not
need to tell you why. However, this does not mean that they can discriminate against you.
DISCRIMINATION
EEOC GUIDELINES: Federal Equal Employment Opportunity laws “do prohibit employers from
discriminating when they use criminal history information.”

Information about arrests and convictions cannot be used in a discriminatory way. In guidance the
EEOC released in 2012 it mentions two ways discrimination can occur: through disparate treatment
discrimination or disparate impact discrimination.

TITLE VII OF THE CIVIL RIGHTS ACT

: This prevents discrimination based on race, color, religion,
sex and national origin in employment. Having a criminal record is not a protected class, but if you
are excluded from work based on a criminal conviction, and you notice that it is disparately applied
to employees, you might have a claim.

: Employers cannot discriminate based on disabilities.

Protections: Prohibits federal employers from asking about an applicant’s criminal record until after
a conditional offer of employment
Remedies / Penalties: There are penalties for any violation of this legislation, which differ
depending on what category the employer falls into, e.g., adverse action warnings and civil
penalties.
JOBS WITH RESTRICTIONS
Some jobs have some restrictions in regard to criminal convictions. You may want to pay attention
to see if there are any restrictions. For example, law enforcement has certain requirements for their
employees, and lawyers have to meet a high standard of character and tness to be licensed as an
attorney.

Websites like indeed.com or ziprecruiter.com are great places to start when you are looking for a
job.
LinkedIn is also a good resource for networking and nding opportunities.

Resumes are an important tool in the application process. Ideas of things to include are your
educational background, volunteer work, relevant work experiences, specic skills and trainings
you have, and other relevant things about you. Ways to improve or enhance your resume would
be to consider exploring volunteer opportunities, obtaining further education or training,
participation in reentry programs, and participation in workforce preparation programs. Always
proofread!
INTERVIEW
Practice! Come up with answers for the typical job interview questions (i.e., what are your
weaknesses and strengths, what can you bring to this position, etc.).
Come prepared with questions. Be polite and condent. Answer each question thoroughly.

There are a couple reasons why having a birth certicate is helpful:
1. It provides your name, birthdate, and birthplace.
2. It can prove if you are a citizenship of the United States, or not.
3. It can also be helpful in obtaining other forms of identication.

All registered, original les are with the Iowa Department of Public Health, Bureau of Vital
Statistics.

Only certain people are authorized to obtain a birth certicate, including person’s
spouse, children, legal parents, grandparents, grandchildren, siblings, or legal representative or
guardian. Please note that legal guardians, legal representatives, and siblings need to provide
additional proof that they are entitled to obtain this information.

In the United States, when you are adopted, your birth certicate is changed to show your

You automatically get one if you are born in the United States and your birth was reported.

You have to complete a driver’s education course, approved by Iowa.
You have to have your learner’s permit for at least a year and a clean driving record for at
least 6 months prior to obtaining an intermediate license.
Your parent or guardian has to consent in writing.
Full License (Class C)

You have to be at least 17 years old.
You have to meet the requirements of the intermediate license.
You have to have an intermediate license for 12 months prior to obtaining a full license.
You have to have a clean driving record for 12 months prior to obtaining a full license.
You have to have 10 hours of supervised driving with your intermediate license (two of those
hours need to be between sunset and sunrise).
If you are 18 years old, you don’t have to meet the requirements of the intermediate license.

HOW DO I RENEW MY DRIVER’S LICENSE?
If you have a driver’s license, make sure it is not expired.
It will expire on the expiration date listed on your card, the license will still be valid
for an additional 60 days after the expiration date.
If it is over the 60 days you can be ticketed for driving on an expired license.
You may renew your driver’s license 180 days before the expiration date.
You will have to pass the vision screening.
If your license has been expired for a year or more, you will have to take the vision screening
and a driving test.

If you are 16-17 years old, you will have to take a driving test if

Your driving instruction requires it.
A court order requires it.
You need to take one to remove a restriction on your license.
You have a medical condition that may impact your ability to safely operate a vehicle.

If you want a specialty or personalize plate, they cost $25 plus a $5 annual registration fee.

It usually takes 3-6 weeks, and upon receipt of the plates, you have 90 days to assign them to a
vehicle. You must exchange your old plates for the new ones.

These are for individuals with a permanent disability.
They can also be issued to a parent or guardian of a child who has a disability if the child
lives with the parent or guardian.
These need to be validated every year with self-certication.
Removable window placards
This is for individual with a temporary disability (6 months).
Or for individuals with a permanent disability (5-year basis).
These expire at a 6-month or 5-year time period.
Stickers
This is an option for an individual with a disability who does not want a specic license plate
These are valid as long as the registration for the motor vehicle is correct.
AM I ELIGIBLE?
“The person cannot walk 200 feet without stopping to rest.
The person cannot walk without the use of, or assistance from, a brace, crutch,
another person, prosthetic device, wheelchair or other assisting device.
The person is restricted by lung disease to such an extent that the person’s forced
expiratory volume for one second, when measured by spirometry, is less than one liter, or
the arterial-oxygen tension is less than 60 mm/hg on room air at rest.
The person uses portable oxygen.
The person has a cardiac condition to the extent that the person’s functional limitations
are classied in severity as Class III or Class IV according to standards set by
the American Heart Association.
The person is severely limited in the person’s ability to walk due to an arthritic,
neurological, or orthopedic condition.”

You also need to provide a medical statement from a medical profession on their letterhead that
the applicant is a person with a disability that is either permanent or temporary.
This information then needs to be returned to an Iowa DOT location (full-service driver’s license

WHY DO I WANT A PASSPORT?
Passports are a good form of a government issued ID and can be used for many purposes (i.e.,
they can be a form of ID that you can show an employer when lling out W-2s for a job). You can
also legally travel outside of the United States to travel for fun or work, or to visit family or friends.
HOW LONG DOES IT LAST?
If you are 15 years old or younger, it will be valid for 5 years.
If you’re 16 or older, if will be valid for 10 years.
It is always best to renew your passport 9 months before it expires.
AM I ELIGIBLE?
You need to be a U.S. Citizen or a U.S. National to obtain a U.S. passport.

There are a couple
other qualications:
You cannot be under a sentence for a federal or state drug felony that you committed
while using a passport or while crossing international borders (i.e., drug trafcking) (22
U.S.C. § 2714; see 22 C.F.R. § 51.61; see also 22 U.S.C. § 2714 for some misdemeanor
offenses).
You cannot have a conviction for sex trafcking (22 U.S.C. § 212a).
You cannot have a court order against you that doesn’t allow you to leave the country (22
C.F.R. § 51.70(a)(2)).
You cannot have warrants out for your arrest (22 C.F.R. § 51.60).
You cannot owe more than $2,500 in child support (42 U.S.C. § 652(k)).
If you are currently under supervision, you need to have written permission from your supervision
ofcer, even if you are allowed to leave the country (i.e., no restrictions from your sentence).

WHY DO I WANT A LIBRARY CARD?
They are free and they allow you to utilize many of the resources in a local library, such as
borrowing books, using the internet and computers, reserving a study room, etc.
This can give you great resources for nding jobs, applying for positions, studying, sending emails,
and other research needs.
If you go to a library, you will have access to librarians who are great help for research questions.
There are also often programs and community events you can participate in at the local library.
HOW CAN I OBTAIN A LIBRARY CARD?
The process might vary a bit from library to library, but nd a local public library, and bring a
photo identication and proof of your address.
They likely will have you ll out a form and walk you through the various programs and
services the library has to offer you.
Do not be afraid to ask a librarian for help—that is what they are there for.
But do watch out for late nes if you do not turn in a book on time.

WHAT IS AN EBT CARD?
This tracks your food stamps and cash assistance.

There is an app that allows you to track things
closely (Fresh EBT). This will also show you what restaurants and stores take EBT.
You will have an EBT card that works like a debit card, but it loaded with your food stamps and
cash assistance. You can use it at any store that accepts EBT. You can also get discounts with your
EBT card.

DO I HAVE TO REPORT?
Yes, you do need to report.
You need to report twice a year about: If someone moves in or out of your household or if you
have nancial changes (i.e., income, rent, savings, or child support).
You have 10 days to report: “When your household income goes over the monthly income limit.
This could be because someone starts making more money or someone with income moves in.
When an adult without a disability or a child (what the government calls an ABAWD) who was
working or training 20 hours/week starts working or training less. The receipt of substantial lottery
or gambling winnings.”

Cash Assistance: Family Investment Program (FIP) is Iowa’s Temporary Assistance to Needy
Families (TANF) program.
WHAT ARE THE LIMITATIONS?
60 months (including in other states).
Months are not counted towards:
Persons on SSI.
Caretakers who don’t get FIP for themselves.
Caretakers are relatives who care for a child, but are not the child’s parent.

This can be extended if you have a “hardship extension”:
i.e., Physical or mental health problems, Substance abuse problems, Domestic
violence .
This can last up to 6 months.

Fines are imposed purely as punishment. They are usually determined by the type of crime (Iowa
Code 903.1):
Simple misdemeanor: $105-$855
Serious misdemeanor: $430-$2,560
Aggravated misdemeanor: $855-$8,540

This cannot be waived.
WHAT IS IT?
Additional costs imposed on convicted defendants and for various charges. 15% of the ne you
owe.
CAN IT BE WAIVED?
None of these can be suspended.
When under supervision, you can enter into a payment plan. This information needs to be
provided to the clerk of court (and will be forwarded to the victim). There needs to be monthly
payments paid to the clerk of court.
It is calculated by the county attorney and the clerk of court.

WHAT IS IT?
1. Funds to a local anticrime organization which provides assistance to local law enforcement;
2. Crime victim compensation program reimbursements;
3. Payment to public agencies pursuant to section 321J.2(13)(b);
4. Court costs; Filing fees are imposed for the ling of a civil or criminal case;
5. Court appointed attorney fees including the expense of the public defender; and Indigent
defense fees are imposed for repayment of a public defender or appointed contract attorney in a
civil, criminal, or juvenile case;
6. Payment to the medical assistance program for expenditures paid on behalf of the victim
resulting from the offender's criminal activity including investigative costs incurred by the Medicaid
fraud unit.

WHAT IS IT?
Jail / room & board: These fees are for time spent in pretrial incarceration, where the defendant is
unable to make bail or obtain bond.
In Polk County: $75 for the rst day, $60 for every day after.
HOW CAN I PAY?
These can be made in person at the jail or they can be mailed: Polk County Jail, Room and Board,
1985 NE 51st Place, Des Moines, Iowa 50313. You can enter into a payment plan with the county
attorney’s ofce.

SHERIFF’S FEES
Fees for service of subpoenas or other paperwork, transport, etc. (Service notice: $15 (at least),
Warrant served: $20, Various other costs associated with sheriff involvement in cases).

Fines and fees are due 30 days after the date it is assessed by a court order.

PAYMENT PLANS
If a ne or fee is not paid within 30 days, it is considered delinquent. However, you can set up a
payment plan with the court. You will need to contact the clerk of court in the county that the
violation was in.

The minimum monthly payment is $50, if a payment plan is set up by a judge.
If your payment is delinquent over 30 days, a third party will step in and you will need to set up a
payment plan with that third party.

If you have a major credit card, you can pay nes, surcharges, and fees on Iowa Courts Online.

PARKING TICKET
These are county or city specic, so you will have to pay through the city or county’s clerk ofce.
The court debt is payable to the clerk of the district court in the county where the parking ticket
was issued.
WHAT MIGHT HAPPEN:
Suspended – this is for unpaid nes, etc. (Iowa Code 321.210).
Revoked – OWI test failure or refusal or alluding charge.
Barred – 2-6 years in duration.
Three strikes (with offenses that lead to becoming barred) (Iowa Code 321.555).

IF YOU LICENSE IS BARRED
There is a location, date, time restrictions. You may be allowed to go to work and daycare.
IF YOU HAVE AN OWI FAILURE OR REFUSAL
There is no location or date restrictions. You need to put an ignition interlock device on all cars you
may drive (own, operate, or whatever vehicle you will be driving). There also is a SR22 insurance
requirement, a civil penalty, and paperwork.

First and last name, date of birth, driver’s license or ID number, and last 5 numbers of your SSN.
INDEFINITE SANCTIONS
Unpaid tickets or medical issues, such as falling asleep at the wheel.
WHAT DO YOU NEED TO DO?
1. Submit a paper application to the DOT (takes approximately 3 weeks).
2. Pay civil penalty. If it is too high you can le a license reinstatement program (through the
county attorney’s ofce). This is an online application. You don’t need to pay tickets (only
need to if you want to obtain your full license).
IF YOU HAD AN OWI, YOU WILL HAVE ADDITIONAL REQUIREMENTS:
3. Evaluation and drinking driver’s school. There are three different classes (determined by court
order). This has to be done to get full license.
4. Install the IID in the vehicle. You will want to do this last.
5. SR22 insurance. Contact your insurance provider to adjust. There are also non owners’ option for
SR22 (specic to insurance company). It is more expensive, higher risk auto insurance.
THE LICENSE REINSTATEMENT PROGRAM (LRP) with the county attorney’s ofce.
It takes a couple weeks to hear back. You need to set up a meeting to pay the initial amount (you
need your insurance information). Then you’ll need to ll out the TRL app with the DOT.
If you do not have a valid license within a year, you have to take a written and driving test with the
DOT.
It can take a while to get a driving test; you may consider going to another surrounding county.
If you have unpaid child support, there is an indenite hold, and you cannot get a TRL or LRP. You
will want to set up a payment plan with the Child Support Ofce.

You can approach the court to modify the plan of restitution. You can argue about ability to pay. It
probably will not be successful on victim restitution.

In Iowa, you need to meet before a judge for an initial appearance within 24 hours after you have
been arrested.
UNIFORM BOND SCHEDULE
This details how much bond for each level of crime. This schedule only applies if (1) the individual
is not arrested for a forcible felony, and (2) the court is not in session.

This is kind of like house arrest, it is if you are already on probation.
Own recognizance.
BOND REVIEW
You can ask for a judge to review your bond at a bond review hearing.
DENY BOND
The court has discretion to deny you bond. If this happens it is usually because you are already on
probation.

WHAT IS THE PURPOSE OF THE REGISTRY?
To act as a deterrent and to protect the community.
WHAT ARE THE REQUIREMENTS?
“On or after July 1, 1995, an individual who has been convicted or adjudicated of a criminal
offense against a minor, sexual exploitation, or a sexually violent crime or who was on probation,
parole, or work release status, or who was incarcerated on or after July 1, 1995 is required to
register. Registration includes individuals that have received a deferred sentence or deferred
judgments and can include convictions from other jurisdictions such as other states and/or federal
convictions.”

LEVELS
There are three different tiers in the sex offender registry.
See Iowa Code § 692A.102 for more information on what crimes are associated with what tiers.
WHAT ARE THE RESIDENCY REQUIREMENTS? (Iowa Code § 692A.114)
A sex offender cannot live within 2,000 feet of the real estate of a school or childcare facility.
ARE THERE ANY EXCEPTIONS TO THE RESIDENCY REQUIREMENTS?
Yes, exceptions to this requirement are:
“The sex offender is required to serve a sentence at a jail, prison, juvenile facility, or other
correctional institution or facility.
The sex offender is subject to an order of commitment under chapter 229A.
The sex offender has established a residence prior to July 1, 2002.
The sex offender has established a residence prior to any newly located school or child care
facility being established.
The sex offender is a minor.
The sex offender is a ward in a guardianship, and a district judge or associate probate judge
grants an exemption from the residency restriction.
The sex offender is a patient or resident at a health care facility as dened in section 135C.1
or a patient in a hospice program, and a district judge or associate probate judge grants an
exemption from the residency restriction.”

HOW LONG AM I ON THE REGISTRY?
An individual who is required to register with the Iowa Sex Offender Registry must register for 10
(ten) years.
If there are any violation of probation / parole or other violation of the Iowa Code chapter, the 10-
year time period will recommence.
The registration will be required for life is there are any subsequent sex-related convictions will
change or if a registrant is convicted of an ‘aggravated offense.’
